Successful representation of Estonian Public Broadcasting in court dispute against tabloid SL Õhtuleht 30.11.2011

On 30.11.2011 Harju County Court left the ruling unaffected in the matter of Estonian Public Broadcasting (EPB) versus SL Õhtuleht and did not satisfy the appeal claim of SL Õhtuleht.

VARUL’s dispute resolution team, lead by senior associate Ramon Rask, successfully represented Estonian Public Broadcasting (EPB) in a court dispute against SL Õhtuleht concerning an article published by SL Õhtuleht on 10.11.2010 which falsely accused a journalist of EPB’s sports department in taking a bribe for concentrating on certain topics when choosing the news.
The court established that the allegations published by SL Õhtuleht were false and damaged the reputation of EPB. The court emphasized that “Estonia is a democratic state without censorship. However, that does not mean that there should not be any self- censorship proceeding from good faith and objectivity towards the transmitted information”.

Harju County Court ruled AS SL Õhtuleht to remove the article from its website and publish a correction on its own expense in the paper issue. The ruling on 30.11.2011 did not satisfy the appeal claim of SL Õhtuleht.
