Varul Vilgerts Smaliukas in the largest tax dispute of the Baltic legal practice Jun 17, 2009
The largest tax dispute in the Baltics, the former shareholders of
Stora Enso Timber (former AS Sylvester against the Estonian Tax and
Customs Board was settled by the 17.06.2009 ruling of Supreme Court of
Estona in favour of the shareholders.
The firm’s tax team, headed by partner Helmut Pikments, advised and successfully represented ten majority and minority shareholders in this landmark dispute that will determine future tax practice in Estonia. The dispute concerned taxation of gains on sales of shares and it also concerned legality of application of the principle of substance-over-form and constitutional rights related thereto.
