State aid: What to do if your competitor receives state aid, but you don’t

State aid clearly is liable to distort competition on any given market. When state aid is awarded to one of competitors, fair competition is called into question, because, above all, state aid does not appear to be anything that can be deserved and earned, and therefore seems unfair.

In this memo we will address issues that might be of interest to those who feel that their ability to compete on equal terms is restricted owing to state aid measures injected in the market. In particular, we will deal with remedies available before the Latvian courts against unlawful state aid and remedies against refusal to grant state aid. The memo might also be useful for those who are interested in the aid scheme for distribution of LVL 603 mio recently introduced by the Latvian government.
