RIGHTS TO LAND

  • Ownership (though in practice only few legal entities have acquired the ownership rights).
  • Permanent right of use.
  • Temporary right of use (for a maximum of 10 years, but can be extended).
  • Lease (the only possible way for non-residents to use land). The maximum lease term is 99 years.

Land ownership and right of lease is generally granted by state authorities at auctions. In some circumstances land may be obtained directly from local authorities.

Liquidation of a company entails termination of the land ownership.

LEGAL FORMALITIES

  • Registration. The real estate itself, as well as any rights thereto and transactions in relation to it should be signed before (notary is an option) and registered with the real estate registrar. Without the registration the aforesaid are deemed to be invalid.
  • Registration of lease agreements. Commercial lease agreements are not subject to state registration (except for the lease of land).
